Most litigation is settled through mediation, rather than at trial. This course will prepare you to effectively advocate on behalf of their client in mediation. The course will 1) examine the role and process of mediation from the perspective of both an experienced lawyer and a mediator; and 2) enable students to develop the skills needed to be a successful negotiator. The course will utilize lectures, videos and assigned readings to examine the various theories, forms and techniques of mediation advocacy.
