The fashion industry serves to regulate a $1.2-trillion global industry with $250 billion spent annually on fashion in the United States. This session will introduce participants to legal issues their clients may encounter when setting up a fashion brand. We will examine how to protect a fashion brand with a discussion of business practices and cases specific to the industry including a leading trademark case “The Red Sole Case” (Christian Louboutin v. Yves St. Laurent), a leading copyright case (Star Athletica LLC v. Varsity Brands) and criminal counterfeit schemes analyzing “The Fake-Handbag case” (United States v. Praepitcha Smatsorabudh). If time permits will discuss additional rules and regulations as time permits such as working with print and runway models including labor laws with a focus on New York’s child Model Law.
