This course will discuss how to draft contractual indemnity clauses, agreements to procure insurance, and additional insured endorsements and the considerations involved in making such provisions work in the real world. Among the topics that will be covered are anti-indemnity statutes, rules of interpretation applicable to indemnity provisions, and the different types of additional insured endorsements available in the insurance marketplace. The course will also cover the interplay between indemnity provisions and agreements to procure insurance.
