This program will focus on the application of the Medicare Secondary Payer Act (MSP) to Liability and No Fault cases. Of note, the program will include a detailed discussion of the October 2017 changes to the Medicare Common Working File, the November 2017 educational outreach by CMS to the medical community and what that may mean for your cases, as well as anticipated MSP enforcement changes expected in 2018.

A significant portion of the CLE will be focused on the statutory requirement that Medicare must remain secondary to liability and no fault settlement proceeds. We will go over techniques to ensure the settlement does in fact remain secondary to Medicare, such as use of a Medicare Set Aside. And we will discuss the risks of failing to maintain Medicare as a secondary payer.
Further, the CLE will include a detailed discussion of the statutory requirement to reimburse Medicare’s conditional payment. The conditional payment discussion will include strategies to efficiently obtain the Medicare conditional payment amount for Medicare A/B, Medicare Part C, and Medicare Part D. Further, a discussion of the multitude of avenues available to seek a reduction of the conditional payment amount, as well as how to decide which is best for your case, will be addressed. Also, the CLE will include information on both the BCRC and the CRC and the differences between the two recovery contractors.
