Course Description

In this section, the attendee will build on what was taught in Introduction to Issues in Military Divorce. The attendee will learn about family support, military service regulations that impact family support, the enforcement of court ordered support orders, and parenting issues that may have an effect on the typical parenting plan. These issues include sample language, the impact of the National Defense Authorization Act of Fiscal Year 2017, the “10/10” rule, indemnification, and the U.S.

Supreme Court case – Howell v. Howell. Also to be discussed will be issues involving military disability retired pay, Blended Retirement versus Legacy Retirement and the division of the Thrift Savings Plan. Finally, the attendee will learn about the Survivor Benefit Plan (SBP) and the impact it can have on the case, deadlines regarding the SBP, and why the length of marriage and overlap with military service is a very important piece of information to have.
