A quiet title action is an equitable proceeding whose purpose is to establish “superiority of title in property.” This course will address some of the fundamental issues that can often arise in such proceedings. Because each state’s laws are different, the course will highlight conceptual issues and practical considerations associated with quiet title actions no matter where one practices in the United States. Selective state laws and the Federal Rules of Evidence and Procedure will be relied on to illustrate some matters.
