Course Description

This course serves as a sophisticated introduction to post-employment restrictive covenants, including noncompete agreements, no-services provisions, nonsolicitation clauses, nondisclosure agreements and nondisparagement terms. It explains the manner in which courts interpret these provisions, and the state limitations that often control the duration and reach of these requirements. Federal restrictions on these provisions, including the December 2022 Speak Out Act, are examined as well.
