Course Description

Unlike decisions by a court, the NLRB may make abrupt changes in policy whenever there is a change on the part of the President of the United States. Now that President Biden has made his appointments to the NLRB, this course will discuss what lies ahead with potential reversals of course from the Trump Board and a return to some Obama-era rulings.

  • Discuss the new makeup of the NLRB and its new General Counsel
  • Overview of the National Labor Relations Act and what role it plays for employers – both union and non-union
  • Analyze what the General Counsel memo released a few weeks ago foreshadows on the new agenda for the NLRB
  • Strategies for all employers to avoid entanglement under the National Labor Relations Act

  1. What are the National Labor Relations Act and the National Labor Relations Board?
  2. What does the new National Labor Relations Board intend to review from the Trump era?
  3. What new shifts in the analysis of the NLRA may occur under new leadership?
  4. What can employers do to avoid litigation under the NLRA?
