Military service and the pay, benefits, and entitlements afforded Service members can drastically affect a Service member/Plaintiff’s claims in personal injury cases, as well as the defenses to those claims. Understanding a Service member’s military career is particularly important when the Army, Navy, Air Force, Marines, Space Force, or Coast Guard determines the Service member is no longer medically fit because of personal injuries suffered outside of their military service.
The attorneys of MNB Meridian Law are widely recognized military personnel experts who explain the arcane intricacies of military service and interplay of military disability discharges and medical retirements with the lifelong benefits provided by both the Departments of Defense and Veteran Affairs. In this course, we explain the Service member/Plaintiff’s military career, promotion and longevity potential, and whether or how the tort injury impacted their remaining military service, if at all. If affected, how DoD and VA pay, benefits, and entitlements will affect their lives, careers, and families.
For example, a Service member injured in a car accident (whether at fault or not) may be medically retired after 10 years of service because the tort injuries render them medically unfit for further military service. The Service member will receive a combination of lifetime DoD retirement and VA disability compensation, as well as medical care from either or both of DoD or the VA, and where appropriate, career retraining, among other free benefits. How that affects claims and damages is profoundly important to each party in the case.
