Course Description

Artificial intelligence presents new ethical challenges for lawyers, including risks related to competence, confidentiality, disclosure, supervision, and billing. Lawyers must understand both the capabilities and limitations of AI tools, as these systems can generate convincing but false information and may inadvertently compromise client confidentiality if sensitive data is uploaded to public platforms. The American Bar Association’s guidance emphasizes that attorneys are responsible for verifying AI-generated content, disclosing material use of AI to clients when appropriate, and supervising junior attorneys and staff who use AI. Failure to meet these obligations has led to court sanctions and disciplinary actions, highlighting the importance of skepticism, transparency, and ongoing education in the ethical use of AI in legal practice.
