Veterans Benefits Law: Fundamentals of VA Disability Claims

Course Description

The CLE will provide an overview of the Fundamental of VA Disability claims, with a focus on the law, process, and procedures governing disability compensation benefits administered by the Department of Veterans Affairs (VA). It will discuss basic eligibility for VA disability compensation, how to file a claim, appealing a denial in light of changes made by Veteran Appeals Improvement and Modernization Act (AMA), and more.

• Understand the Requirements for VA Disability Benefits
  • Successful VA disability claims begin with meeting the fundamental eligibility requirements, including qualifying military service, an appropriate discharge status, and a disability that is connected to military service.
• Establish Service Connection Through the Appropriate Legal Theory
  • Practitioners must understand the various methods of establishing service connection—including direct, presumptive, and other recognized theories of causation—as well as how disability ratings and effective dates are determined.
• Navigate the VA Claims and Appeals Process Effectively
  • Knowledge of the VA’s claims adjudication system, including filing an initial claim, understanding rating decisions, and pursuing appeals under the Appeals Modernization Act (AMA), is essential to effective representation.
• Identify Additional Benefits and Downstream Issues
  • Effective advocacy extends beyond the initial disability claim and includes recognizing eligibility for related benefits such as Total Disability Based on Individual Unemployability (TDIU), Special Monthly Compensation (SMC), Dependency and Indemnity Compensation (DIC), VA pension benefits, and other downstream issues that may affect a veteran’s overall entitlement.
