Kelly Charles-Collins is a Partner with the Tampa firm of Smoak, Chistolini & Barnett and is also a Certified Arbitrator with the American Arbitration Association. As a skilled employment trial lawyer, who defends organizations against employee lawsuits, Kelly understands the tangible and intangible impacts of deficient, non-existent or inconsistent application of processes and policies. Since 1998, Kelly has worked with organizations to minimize legal liability by reducing employee complaints and creating a safe and inclusive workplace free of discrimination, harassment and retaliation. Kelly’s proactive approach to human resources risk management includes encouraging organizations to implement and enforce policies to prevent employee complaints, rather than invest company profits defending lawsuits.
Kelly’s broad range of experience in employment law includes advising on human resources issues and successfully defending litigated matters, in federal and state court and before administrative bodies, involving Title VII, ADEA, FMLA and ADA claims, sexual harassment, wrongful discharge, retaliation, whistleblower, federal and state wage and hour laws, state tort claims and restrictive covenant agreements, including non-compete provisions.
She works with small businesses to multi-billion-dollar, global organizations providing day-to-day preventive counseling, developing company policies, training management and employees, assessing and implementing workplace solutions, and conducting workplace investigations. Kelly is a thought leader and sought-after resource in employment law and human resources management. She has also been an adjunct instructor in human resources at both the University of Miami and University of Phoenix. Kelly is licensed to practice law in Florida, Georgia and the U.S. Virgin Islands.
